The Policy covers both our online and offline data collection activities, including Personal Information that we may collect through our various channels including our websites, apps, third-party partners, retailers and/or networks, points of sales and events.

This Privacy Policy applies to all clients, customers, suppliers of, and applicants for prospective employment or engagement with, RYOBI (“you” or “your”).

SCOPE AND PURPOSES OF COLLECTION OF PERSONAL INFORMATION

When you access certain services and products, we may collect information that personally identifies you (“Personal Information”).

We collect your Personal Information for various reasons to carry on our business, including to provide you our Products and Services, and to facilitate recruitment.

We may also use the Personal Information we collect to:

  • provide you with information about the Products and/or Services you requested and any other services and events you may be interested in;
  • personalise and customise your experiences with us;
  • help us review, manage and enhance our Products and/or Services and develop insights used in reports or other content developed by us;
  • communicate with you, including by email, mobile and in-application notifications;
  • conduct surveys or promotions;
  • to process payments and administer your ‘My RYOBI account’, including to send you account related reminders and join the RYOBI loyalty program;
  • investigate any complaints about or made by you, or if we have reason to suspect you have breached any relevant terms; or
  • as required or permitted by any law.


If you communicate with us by e-mail, or complete online forms, surveys or contest entries, any information provided in such communication may be collected as Personal Information. For example, we may request Personal Information from you when you:

  • contact us for further information;
  • attend an event or participate in surveys and other types of research;
  • enter a promotion, sweepstake, or contest hosted by us;

  • register your details on our website;
  • express interest in a particular TTIA or RYOBI service; or
  • submit a job application or résumé.


If you are a user of RYOBI App, we also collect your location information, for example, about where your tools are or have been but only if you enable the location function or utilise that service in/on the RYOBI website, App, or wider platform including related features. WHAT WE COLLECT

Personal Information we collect about you may include (i) identification information such as your name, business name, username, password, email address, telephone number, (ii) residential address, city, state, postcode, area code, gender, age, purchase history, income, hobbies and interests (iii) products you own, model numbers, date and place of purchase, (iv) credit information; and/or (v) technical information as set out below. Sensitive information is a special category of Personal Information and includes, but is not limited to, information about your health, race or ethnic origin, political or religious beliefs, membership of a trade union or association, or criminal record. Generally, we will not collect sensitive information about you. However, in certain circumstances, we may need to collect limited sensitive information about you, such as where you disclose details of an injury or medical condition to us as part of a warranty claim.

Traffic Data Collected. We automatically track and collect the following information when you visit our website and applications, including your:

  • IP address;
  • domain server;
  • type of device;
  • type of web browser; and
  • other technical logs depending on how you engage with us (collectively Traffic Data).


Traffic Data is anonymous information that does not personally identify you but is helpful for marketing purposes (including screen pop-ups) or for improving your experience on the website.

Other information we collect may include:

  • the Internet Protocol address;
  • the type of browser and operating system you used;
  • the type and model of device you use;
  • the date and time you visited the Platform;
  • the web pages or services you accessed on the Platform;
  • the time spent on individual pages and the Platform overall;
  • which files you downloaded; and

HOW DO WE COLLECT PERSONAL INFORMATION?

We collect Personal Information through various means, including:

  • when you complete an online form, submit a questionnaire, application, consent, purchase, account sign-up or similar form via our website or otherwise, including the RYOBI App;
  • when you contact us to make a query or request;
  • when you access, post information or otherwise interact with our website and applications, including on the ‘My RYOBI Account’ and RYOBI App;
  • when you participate in one of our competitions or surveys;
  • from anyone who request our Products and/or Services on your behalf;
  • from our third-party service retailers, providers, partners, platforms and/or tools;
  • from publicly available sources of information;
  • from government regulators, law enforcement agencies and other government entities;
  • from business contacts, external service providers and suppliers; or
  • by any other means reasonably necessary and permitted by law.


Where possible, we collect your Personal Information directly from you. However, in some situations, we may need to obtain your Personal information from a third party (e.g. our partner or retailer) or other source. If we collect information about you in this way, we will only do so if it is unreasonable or impracticable to collect it from you directly. 

Unsolicited information. If we receive unsolicited Personal Information about you that we could not have collected in accordance with this Privacy Policy and the Privacy Act, we will, within a reasonable period, destroy or de-identify such information received.

Minors. Our products and services are not suitable or intended for, and we generally do not collect or handle the Personal Information of, minors or individuals under the age of eighteen (18) years old. If you are under the age of 18 you will need the consent of your parent or guardian in order to provide your Personal Information to us. 

Anonymity. If you would like to access any of our Services or otherwise deal with us on an anonymous basis, please tell us and if it is possible and lawful, we will take reasonable steps to comply with your request, however:

  • we may not be able to provide the services or supply the product if we are not provided with the Personal Information requested;
  • you may be precluded from taking advantage of some of our competitions or promotional offers; and
  • we will require you to identify yourself if:
    - we are required by law to deal with individuals who have identified themselves; or
    - it is impracticable for us to deal with you if you do not identify yourself or elect to use a pseudonym.
     

Destruction. Subject to a legal requirement to the contrary, for any Personal Information collected and held by us, we will take reasonable steps to destroy or de-identify your Personal Information if:

  • the purpose for which we collected the Personal Information from you no longer exists or applies, which includes if your account remains inactive for a sufficient period of time for us to determine it is no longer in use; or
  • you delete your account.


HOW AND WHY DO WE USE OR DISCLOSE YOUR PERSONAL INFORMATION?

We use or disclose your information to better understand your needs and provide you with our products and services. We may share your Personal Information amongst our related bodies corporate in the Techtronic Industries Company Limited (TTI Group) group of companies. We may use or disclose your Personal Information:

  • to deal with your queries or customer service issues promptly, whether by email, telephone or mail. We may also keep information on your communications with our customer service representatives for quality assurance and training purposes, and as permitted by law to do so;

We may de-identify your Personal Information, for example, your demographic profile information or purchase information that we hold, and use this de-identified information to provide insights and analytics services for RYOBI to improve our services to you. We may also share de-identified information with third parties for similar purposes.

We may disclose personal information to:

  • third parties engaged by us to perform functions or provide our Products or Services on our behalf;
  • third parties as required for them to provide services to us or services related to the purpose for which you provided the Personal Information;
  • retails partners and third parties;
  • our professional advisors, including our accountants, auditors and lawyers;
  • our related bodies corporate and affiliates;
  • persons authorised by you to receive information held by us, including to those individuals that you authorise us to provide information to via our website or the RYOBI App;

DIRECT MARKETING

OVERSEAS DISCLOSURE

We do in some circumstances disclose your Personal Information, such as your name, address and email address to overseas recipients but only to the extent necessary to provide you with the products and services requested by you. For example, for storage and processing and as a result of the website and application servers being located overseas. We also disclose Personal Information overseas to our related entities and bodies corporate and affiliates located around the world which include the United States and Hong Kong. Other third-party overseas recipients may be based in locations around the world, including in the United States and the Philippines.

Those overseas recipients may obtain, process and use your Personal Information for a number of purposes, including as set out in this Policy. This may include your e-mail address to address any network and support issues about RYOBI branded products and services in the areas of power tools, hand tools, test and measurement and accessories.

If we do send your information overseas, we take steps to ensure that there are appropriate privacy, data handling and security arrangements in place to protect your information.

ACCESS TO AND CORRECTION OF YOUR PERSONAL INFORMATION

Generally, you have the right to see, obtain a copy of, or request the correction of Personal Information about you that we may hold. If for any reason we are unable to give you access to, or to correct, your Personal Information, we will let you know why in writing (if we can). There is no fee to request your Personal Information, but sometimes we might charge a fee to cover the time we spend gathering the information you have requested. If there’s a fee, we’ll let you know how much it is likely to be, so you can choose if you wish to go ahead.

  • use reasonable endeavours to respond to your request within 30 days or otherwise within a reasonable period; and
