1. Information on how to enter this promotion and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. By entering this RYOBI Deep Cleaning Essentials competition/promotion ("Promotion”), you agree to these Terms and Conditions, which will at that time, become binding between you and us.
  2. No salesperson, representative or agent is authorised by us to give any guarantee, warranty or representation in addition to, or contrary to these Terms and Conditions.
  3. The Promoter is Techtronic Industries Australia Pty Limited (ABN 98 002 277 509) of 31 Gilby Road, Mount Waverley VIC 3149, telephone 1300 361 505 (“Promoter”).
  4. Entry is only open to Australian residents aged 18 years or over.
  5. Employees (and their immediate families) of the Promoter, and agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, defacto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  6. The Promotion commences at 9.00AM AEDT on 21/10/2024 and closes at 11:59pm AEDT on 4/11/2024 (“Promotional Period”). The time of entry will be deemed to be the time the entry is received by the Promoter. No entries will be accepted outside this time unless extended by the Promoter.

  7. To enter, individuals must complete the following steps during the Promotional Period:

    1. 1) Locate the promotional post made by RYOBI on one of the RYOBI social media profiles (https://www.instagram.com/ryobiau/ or  https://www.facebook.com/RyobiAU)

    2. 2) Comment on one of these promotional posts in 25 words or less why your home needs a deep clean with RYOBI products and The Pink Stuff products.

    For clarity, entries will only be considered where comments by entrants are made on one of those promotional posts.

  8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  9. Incomplete, indecipherable, or illegal entries will be deemed invalid.
  10. Multiple entries permitted, subject to the following:  a) each entry must be substantially unique; and (b) each entry must be submitted separately and in accordance with the entry requirements.
  11. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to request identification documentation from an entrant and/or to determine the identity of the entrant.
  12. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on two (2) categories on a scale of 1 to 5 (5 being the highest). The two (2) categories are: (1) meets or is under the 25 word limit; (2) the creativity of their answer as to why their home needs a deep clean with RYOBI products and The Pink Stuff products.
  13. There will be one draw that is conducted for this Promotion. Entries open at 9.00AM AEDT 21/10/2024 and close on the 4/11/2024 11.59 pm AEDT. All draws will take place at Techtronic Industries Australia Pty Limited, 31 Gilby Road, Mount Waverley VIC 3149 on the 11/11/2024 10.00 AM AEDT.
  14. The Promoter may draw additional reserve entries and record them in order, in case of an invalid entry or ineligible entrant is drawn. The Winner’s name will be published on the RYOBI website at https://www.ryobi.com.au/winners from 12/11/24 for a period of no less than 28 days.
  15. The best one valid entry as determined by the judges, will win a prize being a deep cleaning essentials pack valued up to RRP$1893.71 AUD.
  16. The Promoter’s decision is final and no correspondence will be entered into.
  17. The winner will be notified on 11/11/2024 via the relevant promotional post in the comments, it is then up to the winner to contact RYOBI via direct message on either our Facebook page https://www.facebook.com/RyobiAU or Instagram page https://www.instagram.com/ryobiau/ to be provided instructions on how to claim their prize.
  18. The winner must contact RYOBI to claim the prize by 5pm AEDT on 11/12/2024 if the winner fails to do so the prize will be forfeited.
  19. Subject to the unclaimed prize draw clause, if for any reason a winner does not claim a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
  20. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal (or greater) value and/or specification, subject to any written directions from a regulatory authority.

  23. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
  24. Prizes will be posted by registered mail to the address provided by the winner at the time of contact from the Promoter.
  25. Entrants are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize(s). The Promoter accepts no responsibility for any tax implications that may arise from accepting a prize. Entrants are responsible for any and all expenses that they incur in entering the Promotion and they will not be reimbursed for doing so.
  26. A draw for any prize, if unclaimed, may take place on 13/12/2024 at the same time and place as the original draw, subject to any written directions from a regulatory authority. The winners, if any, will be notified in writing within two (2) business days of the draw via the promotional post comments. Winners names will be published online at https://www.ryobi.com.au/winners from 16/12/2024 for no less than 28 days.
  27. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including as a result of electronic tampering or fraud, the Promoter may, to the fullest extent permitted by law, (a) disqualify any entrant, entry, or (b) modify, suspend, terminate or cancel the Promotion, where necessary and appropriate under the circumstances, subject to any written directions from a regulatory authority. The Promoter may in its absolute discretion not accept a particular entry, may disqualify an entry, subject to any written directions from a regulatory authority. The Promoter reserves the right to verify the validity of entries, prize claims and entrants and to disqualify any entrant who submits an entry or prize claim that is misleading, fraudulent, or not in accordance with these Terms of entry or who manipulates or tampers with the entry process. The Promoter may disqualify any entrant who it has reason to believe has breached any of these Terms of entry or engaged in any unlawful or other improper misconduct calculated to jeopardize the fair and proper conduct of the Promotion. If a winner breaches these Terms of entry, the winner will forfeit the prize in whole and no substitute will be offered.

Entry and continued participation in this Promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php or Instagram’s Terms of Use, which can be viewed at https://help.instagram.com/581066165581870 (as applicable).
  29. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The Promoter is not responsible for any technical malfunctions or problems with internet or network congestion.
  30. This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram. Entrants understand that they are providing their information to the Promoter and not to Facebook or Instagram. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this Promotion must be directed to the Promoter and not to Facebook or Instagram.
  31. As a condition of entering into this Promotion, entrants agree to assign all their rights in and to their entry. Entrants can contact the Promoter by email if they no longer approve of their content or entry being published (Social@ryobi.com.au).
  32. The Promoter collects personal information ("PI") in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and related entities of the Promoter. Some of these third parties are located outside Australia, by entering into this Promotion an entrant is consenting to the disclosure of an entrant’s PI to entities outside of Australia. For further information, please see the Promoter’s Privacy Policy which can be viewed at https://www.ryobi.com.au/privacy . Entry into the Promotion is conditional on providing certain PI. The Promoter will also use and handle all PI as set out in the Promoter’s Privacy Policy. In addition to any use that may be outlined in these Terms and Conditions and the Promoter’s Privacy Policy, the Promoter may, unless otherwise advised, use the PI for promotional, marketing, publicity, research, survey and profiling purposes, including sending emails/electronic messages, SMS or telephoning the entrant. The Promoter’s Privacy Policy also contains information about how entrants may opt out of any communication, access, update or correct their PI, how entrants may complain about a privacy breach or concern and how those complaints will be dealt with. All entries become the property of the Promoter.
  33. The Promotion and these Terms and Conditions of entry will be governed by the laws of Victoria, Australia. Entrants accept the non-exclusive jurisdiction of courts and tribunals of Victoria, Australia in connection with the Promotion and these Terms and Conditions.
